The Board of Directors has recently received several questions regarding what types of pools and recreational water structures are permitted within the community under the Association’s Covenants, Conditions, and Restrictions (CC&Rs).

To ensure consistent enforcement and avoid confusion moving forward, the Board is providing the following clarification regarding the interpretation of the existing restriction prohibiting above-ground pools.

Definition of Above-Ground Pools

For purposes of enforcement under the Association’s CC&Rs, an “above-ground pool” includes any pool or similar recreational water structure that is wholly or partially supported above the natural ground level, whether temporary or permanent in nature.

This includes, but is not limited to:

  • Metal-frame pools

  • Resin-sided or vinyl-sided pools

  • Intex-style or portable pools

  • Soft-sided pools

  • Inflatable pools intended for swimming or prolonged seasonal use

  • Semi-inground pools where any substantial portion remains above grade

  • Pools installed with surrounding decking intended to conceal an above-ground structure

Structures Not Intended Under This Restriction

The Board does not currently interpret this restriction to include:

  • Small children’s splash pools or wading pools intended for temporary daytime use

  • Splash pads or similar recreational water play items that are removed after use

Enforcement Moving Forward

Per our community’s Covenants, and Restrictions (C&Rs), above-ground pools are not permitted within phases 3-7 of our neighborhood. This policy is in place to preserve the aesthetic standards of our community and to promote safety and liability protection for all homeowners.

It is important to note that if an unapproved or non-compliant pool were involved in an accident—particularly one resulting in injury or drowning—both the homeowner and the HOA could face potential liability. Enforcing our established rules helps protect the entire community from these risks.

The Board’s responsibility is to enforce the CC&Rs uniformly and consistently as written. This clarification is intended to provide transparency and fair notice to all homeowners regarding how the Association will interpret and apply the existing restrictions moving forward.
